 Section 4 – Criminal Law of the Isle of Teletus

4.1 – Jurisdiction of Law


4.1.1 The High Council, the Ubar and Regent in his absence, and the Ubarate shall hold supreme authority over the Laws of the Isle of Teletus. All acts of Treason shall fall under their exclusive jurisdiction, together with the High Magistrate.


4.1.2 Civil and City Magistrates shall preside over judicial cases involving Citizens of the Isle of Teletus, including felonies, permanent collars, and capital punishment. The High Magistrate shall retain authority to overrule their judgments.


4.1.3 Praetors and Merchant Magistrates shall adjudicate matters of Merchant Law and cases involving non-Citizens, including minor misdemeanors in both public and private hearings.


4.1.4 Advocates and Investigators shall be empowered to collect evidence, interrogate witnesses, and prepare prosecutions or defenses before the Magistrates.


4.1.5 Warriors and Guards of the Isle of Teletus shall be vested with authority to prevent and suppress crime, assist in felony investigations 

, execute warrants, and enforce lawful sentences. if assigned to do so,


4.1.6 Court Clerks shall maintain official records of all incidents and proceedings.


4.1.7 Warrior Clerks shall maintain records of all incidents specifically involving Warriors or Guards.

4.2 – Conviction of Crimes


4.2.1  A first offense shall be classified as a misdemeanor and shall not require trial proceedings.


4.2.2  Misdemeanors shall be adjudicated by a Magistrate (for Citizens),  Praetor (for non-Citizens), or a Merchant Magistrate (for Merchant Law).



Felonies


4.2.3  Repeated misdemeanor offenses shall thereafter be classified as felonies.


4.2.4  Felonies shall require a full trial before a Magistrate.


4.2.5  Felonies committed under Merchant Law shall be adjudicated by the Merchant Magistrate or a regular Magistrate if there is no Merchant Magistrate."

4.3 – Crimes and Punishments


4.3.1 Property Damage – Willful or negligent damage to private or city property shall be punished by full restitution. Failure to pay shall result in public whipping.


4.3.2 Arson – Negligent or willful fire-setting shall be punishable by fines, public labor, enslavement, or death, depending on loss of life and destruction.


4.3.3 Slander – Knowingly spreading falsehoods shall incur a fine for the first offense. Repeated offenses shall result in escalating punishments as determined by a Magistrate.


4.3.4 Face-Stripping of Free Women – It shall be unlawful to strip the veil from a Free Woman of Teletus. Violators shall be fined or punished at the Magistrate’s discretion.  Exception: This law shall not apply to captured non-Citizens, whose treatment is governed by Capture Rights.


4.3.5 False Claim of Caste – Any Free Person falsely claiming membership in a Caste, including by wearing its insignia, shall be subject to fines or enslavement according to the severity of the offense.


4.3.6 Unlawful Orders to Slaves – Any Free Person who commands a slave to commit an unlawful act shall bear responsibility and be punished as if they themselves committed the crime.

4.4 – Specific Felonies


4.4.1 Theft


4.4.1.a First Offense: Ear notching.


4.4.1.b Second Offense: Loss of a hand (Free Men) or enslavement (Free Women).


4.4.1.c All recovered property shall be returned to its rightful owner, or, if no claimant exists, transferred to the City Treasury.


4.4.2 Rape

Defined as compelling a Free Woman to sexual acts against her will or the will of her guardian or Companion.


4.4.2.a  Conviction requires testimony, witnesses, or medical evidence


4.4.2.b  Punishment: Restitution in silver or gold equal to her Companion price, with additional penalties as determined by Magistrates.


4.4.3 Assault - Defined as a willful attack with the intent to harm, excluding lawful duels or Warrior challenges.


4.4.3.a  Punishment shall be proportionate to the severity, at the discretion of the Magistrates.


4.4.3.b  Assault with a deadly weapon or force sufficient to cause death shall be treated as attempted murder.


4.4.3.c  Assault upon a Teletian official (Warrior, Guard, Magistrate, Ubar, or Ubara) shall result in loss of a hand (Free Men) or enslavement (Free Women).


4.4.4 Murder

Defined as the unlawful taking of the life of a Free Person.


4.4.4.a First Offense: Punishment at the discretion of Magistrates, up to and including death.


4.4.4.b Second Offense: Death.


4.4.5 Justifiable Homicide

Homicide shall be deemed justifiable when committed:

    (a)  In defense of the Home Stone,

    (b)  In acts of war,

    (c)  In execution of a lawful sentence,

    (d)  In self-defense,

    (e)  In defense of others,

    (f)  In medical practice, if unintended,

    (g)  Against a slave (which does not constitute murder under the law),

    (h)  By a Warrior, under his Codes, against a Free Woman who has submitted and refuses to honor her submission.


4.4.6 Medical Reports – Physicians shall issue autopsy reports in all cases of unexplained death or homicide.

4.5 – Arrests and Hearings


4.5.1 No Free Person shall be arrested without a warrant issued by a lawful authority.


4.5.2 Warriors may act without a warrant only in cases of immediate danger, detaining the accused until a Magistrate is available.


4.5.3 All suspects, Citizen or visitor, shall be entitled to a hearing for their first and second offense.

4.6 – Trials and Convictions


4.6.1  A Free Person summoned before a Magistrate who refuses to appear may be seized and compelled to attend.


4.6.2  Trials may proceed in absentia if the accused cannot be located.


4.6.3  No Citizen shall be tried twice for the same offense. Trials can be reopened if new evidence is discovered"


4.6.4  False testimony shall be punishable by execution or exile.


4.6.5  Officials shall provide, within one hand of imprisonment, a full account explaining why a Citizen’s liberty is restrained.  Warriors or Magistrates shall file an Incident Report to the Head Magistrate  and to the  Head Scribe within one hand of imprisonment, a full account explaining why a Citizen’s liberty is restrained within one hand of imprisonment, a full account explaining why a Citizen’s liberty is restrained.

4.7 – Execution


4.7.1 Execution may be decreed by Magistrates, with the manner of death determined by the High Magistrate.


4.7.2 A certificate of death and autopsy shall be submitted by a Physician to the High Council, Law Officials, and the family of the condemned

4.8 – Pardons and Release


4.8.1 The High Council may issue pardons at its discretion, with full records submitted to the Magistrates and Scribes.


4.8.2 The High Council may issue posthumous pardons, thereby restoring honor to the deceased and their family.


4.8.3 Only the High Council may demand the immediate release of a prisoner, with lawful cause submitted to the High Magistrate.


4.8.4 The High Council, or Ubar, may reduce sentences imposed by Magistrates, though such reduction shall not absolve the underlying crime.

4.9 – Outlaws


4.9.1 The High Council shall retain sole authority to declare any Citizen an Outlaw.


4.9.2 Outlawry shall be formally enacted by public refusal of bread, salt, and fire in the Council chamber.


4.9.3 The Caste of Scribes shall maintain permanent records of all persons declared outlaw or banished from Teletus.
